There is a recent Florida bill (HB1355 or SB264), which passed the state Senate, was amended by the House, and now is heading back to the Senate, restricts citizens of China, Cuba, Iran, North Korea, Russia, Syria, and Venezuela from acquiring farmland or any property within 20 miles of a military installation or infrastructure such as a seaport or airport. Chinese people who are not U.S. citizens or lawful permanent residents would be barred from owning Florida property altogether. This bill was motivated by what Governor DeSantis considers as the national security reason while some considers this as a measure to prevent dramatic increase in real estate values and empty homes. An amendment allowing visa holders to own one home, but such landowners must register with a state agency. The bill also established criminal penalties for knowingly selling land in violation of the new regulations and a mechanism for land to be forfeited to the state. in italics, below:

Interests of Foreign Countries: Prohibits governmental entities from knowingly entering into contracts & taking specified actions relating to contracts that give access to personal identifying information; requires government entities to require affidavit from applicants before providing any economic incentive; prohibits foreign principals from purchasing agricultural land & certain real property in state; prohibits People’s Republic of China, Chinese Communist Party, any other political party or member of political party in People’s Republic of China, & certain persons & entities from purchasing or acquiring real property in state; requires information held by health care providers utilizing certified electronic health record technology to be maintained in specified locations.

There are legitimate national security concerns underlying the introduction of this legislation, including the safeguarding of defense and critical infrastructure from potentially malign foreign influence. SB 264 and HB 1355 as written however, are both overly broad and vague, prohibiting the acquisition of real estate, not only by state-owned entities or communist party officials, but by any Chinese resident who is not a US Citizen or Green Card holder, by any Chinese corporations or partnerships, even those without political affiliation, and in fact, by “any member of the People’s Republic of China” which could be read to mean anyone holding Chinese citizenship, even if they are also U.S. citizens or lawful permanent residents of the United States.
