The Supreme Court has decided that OSHA overstepped its authority in ordering mandates affecting 84 million private sector workers, in 6:3 decision. In dissenting opinion, Justice, Justice Stephen G. Breyer, Justice Elena Kagan, and Justice Sonia Sotomayor wrote, in itlics, below:
“Today, we are not wise. In the face of a still-raging pandemic, this Court tells the agency charged with protecting worker safety that it may not do so in all the workplaces needed.”
In a separate 5:4 decision, justices upheld the vaccination requirement for medicare and medicaid providers covering about 10 million healthcare workers nationwide.

As the COVID surge continues to worsen during this winter, President Biden said he would make another half billion rapid antigen tests freely available to Americans. White House had previously announced the purchase of half a billion tests in December, 2021, but those kits had not yet been distributed.
