There has been much debate between people who believe in vaccine mandate and those who are anti-vaxxers. At this juncture, already more than a year into the pandemic, there may be an acceptable middle ground that needs to be considered because many people have already acquired natural immunity against COVID-19.

NCLA’s client Prof. Todd Zywicki joins CNN to explain how George Mason University (GMU) is threatening employees with disciplinary action that includes “unpaid leave or possible loss of employment” if they don’t comply with the public university’s vaccine mandate. NCLA has filed a complaint in the U.S. District Court for the Eastern District of Virginia on behalf of Antonin Scalia Law School Professor Todd Zywicki against GMU’s unconstitutional reopening policy for the Fall 2021 semester. The policy requires all unvaccinated faculty and staff members, including those who can demonstrate natural immunity through recovery from a prior Covid-19 infection, to not only disclose their vaccination status as “a prerequisite for eligibility for any merit pay increases,” but also be forced into choosing between their health and personal autonomy and suffering serious detriment to their professional careers. Professor Zywicki has recovered from Covid-19 and thereby acquired robust natural immunity, as confirmed in multiple positive SARS-CoV-2 antibody tests during the past year. Professor Zywicki’s immunologist, Dr. Hooman Noorchashm, has advised him that, based on his personal health and immunity status, it is medically unnecessary to get a Covid-19 vaccine—and that it violates medical ethics to order unnecessary procedures. Affidavits from Drs. Is it possible for both sides (vaccine-mandate believers and anti-vaxxers) to reach the compromise of: Allowing employees to provide either positive Antibody test result or proof of vaccine in order to continue with employment. Given that many of these workers may had already acquired natural immunity from previous exposure to the virus and the recent study from Israel concluded that natural immunity confers longer lasting and stronger protection against infection, symptomatic disease, and hospitalization caused by the Delta variant of SARS-CoV-2 (aka COVID-19), compared to the BNT162b2 (aka Pfizer COVID-19) two-dose vaccine-induced immunity by 13 fold.
The two types of acquired immunity are adaptive and passive. Adaptive immunity occurs in response to having been infected with or vaccinated against a microorganism. The body makes an immune response, which can prevent future infection with the microorganism. Passive immunity occurs when a person receives antibodies to a disease or toxin rather than making them through his or her own immune system. If the calculation for adaptive immunity includes both “response to having been infected with” and “response to vaccinated against” a microorganism (in this case, COVID-19), it is possible that herd immunity may still be reached in Florida by the end of 2021 as a result of vaccination + natural immunity from previous infection. The best way to determine whether or not one has the ability or immunity to fight against the COVID-19 is by testing the amount of antibodies one has, either acquired from previous infection or acquired from vaccination.
