On Friday, August 5, 2021, the parents of fifteen children filed lawsuit because they believe that Governor DeSantis’ executive order banning mask mandate would cause the virus to spread. Under Florida law, students are entitled to safe schools. Six attorneys feel that safe school is being threatened amid a spread of the Delta variant and an Executive Order from Governor Ron DeSantis banning school mask mandates. Governor DeSantis said that schools with mandates will lose state funding, but according to the Florida State Constitution, the power of running schools is in the hands of each school district. Attorney Gene Nichols said, “So the real question is going to be: whether or not the governor has the authority to issue an executive order to trump the Florida Constitution. In essence, it is what he is currently doing. And that is what the court is going to have to decide.” Nichols added, “Governor has 20 days, from the day of being served, to respond to this lawsuit. Supreme Court is going to have to make the decision on this because it is a constitutional issue.”

Similar lawsuit is also taking place in Arkansas. Children are headed back to school in Arkansas this month, where coronavirus infections, hospitalizations, and deaths are skyrocketing. Arkansas Governor Asa Hutchinson now says he regrets signing a bill prohibiting local governments from enacting mask mandates and could protect children in classrooms.
