Trump Caves On Citizenship Question For 2020 Census

On Thursday, July 11, 2019, during the Rose Garden press conference, President Trump announced that he was abandoning plans to add a citizenship question to the 2020 U.S. census. Instead, he directed federal agencies to share government records to determine head-count of citizens without polling census takers directly. He was not backing away from attempting to obtain a count of U.S. citizens by stating, “We are not backing down on our effort to determine the citizenship status of the U.S. population.”
Trump surrendered to the Supreme Court and decided not to go ahead with his attempts to put a citizenship question on the 2020 census. To save face, he issued an executive order that pushes the government to gather info on citizenship that it already gathers. Trump issued an executive order directing the Commerce Department to obtain citizenship data through other means: such as Documents from the Department of Homeland Security (which houses citizenship and asylum services), and the Social Security Administration. This order was signed and released to reporters late Thursday night. Trump believes that the immigration matter remains an important contributing factor for his popularity among conservative voters, and hopes to solidify his position before facing reelection. He said that agencies would be required to provide the Commerce Department with documents and records of citizens and non-citizens, providing an accurate picture of U.S. citizenship population. But according to Neal Katyal, the Former Acting U.S. Solicitor General, in the video above, the executive order is simply asking the census bureau to use its existing data basis to collect information, which has been argued by census bureau and challenger to addition of the citizenship question to 2020 census all along. So Trump’s executive order is simply ordering what’s already been done.
Attorney General William Barr indicates that the decision is one of legal practicality rather than of ideological shift, saying “There is simply no way to litigate these issues and obtain relief from the current injunctions in time to implement any new decision without jeopardizing our ability to carry out the census…a logical impediment, not a legal one.” Barr also noted that the Supreme Court determined that including a citizenship question would not be unconstitutional, ruling instead the “Commerce Department did not adequately explain its decision s for doing so on the 2020 census.”

House Speaker Nancy Pelosi said, “If he had tried to defy the Supreme Court, that would’ve been a constitutional crisis…So for the basis of the census and the citizenship question, I’m glad it’s gone. For the basis of the country I’m glad that he was advised not to try another route to add the question to the census.”
