About two days after special counsel Robert Mueller III’s first statement about Russia probe appeared, Elizabeth Warren made her statement in a post at Medium. On Friday, May 31, 2019, Senator Elizabeth Warren of MA called for Congress to pass a law clarifying that the president can be indicted for his/her alleged crimes, even while in office, as well as amend obstruction of justice statutes “to explicitly allow for indictment when the President abuses the powers of the office”. Warren also vowed that if and when she is elected president, she would appoint an attorney general who will protect the rule of law and an assistant attorney general in charge of the Office of Legal Counsel who will reverse Justice Department opinion holding that sitting presidents cannot be indicted. Warren is the first Democratic presidential hopefuls to call for impeachment proceedings, and said that lawmakers should go even further.
Keep in mind that “Sitting president cannot be indicted” is a legal opinion, a guideline, not in the Constitution and not a law.
Warren said, “Mueller’s statement made clear that those of us who have read his report already knew: He’s referring President Trump for impeachment, and it’s up to Congress to act…But impeachment isn’t supposed to be the only way that a President can be held accountable for committing a crime. That’s why I’ve got a plan to make sure that no President is above the law.”
Again: Keep in mind that “Sitting president cannot be indicted” is a legal opinion, a guideline, not in the Constitution and not a law.
