U.S. District Judge of Northern District of California Jon Tigar ruled on Monday, Nov. 19, 2018, that the Trump administration can’t limit asylum applications to only those people who enter the U.S. at the legal border crossings. This is in response to the proclamation issued by the president on Nov. 9, 2018, that said any one who crossed the southern border between official ports of entry would be ineligible for asylum. This temporary halt to the asylum ban will be heard again on Dec. 19, 2018, when a final injunction may be established. At this moment, the ban is deemed unlawful. As the first of several caravans of migrants have started arriving at the U.S.-Mexico border, Trump said an asylum ban was necessary to stop what he considered as a national security threat. But in his ruling on Monday, U.S. District Judge Jon Tigar agreed with legal groups that immediately sued, arguing that U.S. immigration law clearly allows some one to seek asylum even if they enter the country between official ports of entry.
