Issues With Acting AG Matthew Whitaker Appointment/Nomination

Since I’ve posted “Attorney General Jeff Sessions Resigns, At President Trump’s Request” on Nov. 7, 2018, I’ve received quite a few alarmed emails and/or texts from various worried readers. So, please allow me to point out that a principal officer, such as Attorney General, must be nominated by the president and confirmed by the Senate under its “Advice and Consent” powers, according to the Appointments Clause of the Constitution, Article II, Section 2, Clause 2.,rather than just being appointed by the president. I would like to share some of the analysis of various scholars or legislators who are familiar with the potential ramifications and procedures of the firing of Jeff Sessions and appointment of Matthew Whitaker as the acting Attorney General, setting off the beginning stage of a constitutional crisis. Former Solicitor General Neal Katyal stated that the safety check would be placing the regulation that would require the reporting to Congress if the Acting Attorney General would either terminate Mueller investigation or restrict Mueller investigation by reducing budget or any other method.
Allow me to remind us: it is very fortuitous that we do now have Democrats controlling the House.
