On October 30, 2018, President Trump stated, in an interview with Axios on HBO, that he would end birthright citizenship (conferred by Section 1 of the 14th Amendment) through an executive order presumably targeting the children of undocumented parents. Let’s take a look at the 14th Amendment of the U.S. Constitution, in italics, below:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
Professor Neal Katyal along with Kellyanne Conway‘s husband, George Conway III, wrote a new Washington Post op-ed on the president’s proposal to end birthright citizenship, “Trump’s proposal to end birthright citizenship is unconstitutional” at the Washington Post. Below, Katyal joins Morning Joe to discuss:
“Sometimes the Constitution’s text is plain as day and bars what politicians seek to do. That’s the case with President Trump’s proposal to end “birthright citizenship” through an executive order. Such a move would be unconstitutional and would certainly be challenged. And the challengers would undoubtedly win….The fact that the two of us, one a conservative and the other a liberal, agree on this much despite our sharp policy differences underscores something it is critically important to remember during a time marked by so much rancor and uncivil discourse: Our Constitution is a bipartisan document, designed to endure for ages. Its words have meaning that cannot be wished away.”
