The Trump administration has been holding back 100,000 pages of documents related to Supreme Court nominee Brett Kavanaugh‘s service (during his time as a lawyer in the former President Goerge W. Bush‘s administration) from the Senate. On Friday, August 31, 2018, this decision is disclosed in a letter from Mr. Bush’s attorney to Senator Charles E. Grassley of Iowa, chairman of the Senate Judiciary Committee, just days before the beginning of Judge Brett Kavanaugh’s confirmation hearings on Tuesday, September 4, 2018. Presidents may use executive privilege under the Constitution to prevent other branches of government from gaining access to certain internal executive branch information, so that the president and top White House officials may communicate freely with one another. But such an unprecedented decision has received much condemnation from the Democratic leader, Senator Chuck Schumer of New York.
Mr. Schumer tweeted “We’re witnessing a Friday night document massacre. President Trump’s decision to stop in at the last moment and hide 100K pages of Judge Kavanaugh’s records from the American public is not only unprecedented in the history of SCOTUS noms, it has all the makings of a cover up.” on Saturday, September 1, 2018. Democrats and Republicans have been arguing for weeks for access to documents relating to Judge Kavanaugh’s time working for the Bush administration. Democrats believe that this decision to block the access to these documents is an effort to ram through the nomination without sufficient scrutiny. Senate Democrats also indicated that this is the first time that a sitting president has used executive privilege under the Presidential Records Act to prevent documents from being released to Congress during a Supreme Court confirmation process.
To better understand why the Trump administration is in strong support of Kavanaugh, the video “What you should know about Brett Kavanaugh’s life and record“, below:
Note: Senator Durbin wrote, “Dear Judge Kavanaugh, by testifying under oath that you were not involved in this issue, it appears that you misled me, the Senate Judiciary Committee, and the nation.” and later Senator Patrick J. Leahy, the chairman of the Judiciary Committee at the time, referred the alleged misstatements to then Attorney General Alberto Gonzales for possible prosecution.”
Rachel Maddow outlines the historic depth of the unpopularity of Donald Trump’s pick for Supreme Court, Brett Kavanaugh, and and unearths audio of Kavanaugh looking for legalistic excuses to keep a 17-year-old pregnant immigrant from exercising her constitutional right to an abortion, in the video “U.S. Women See Reason To Reject Donald Trump SCOTUS Pick Brett Kavanaugh” below:
