Last week’s a 20-page letter to special counsel Robert S. Mueller III, from Trump’s attorney Jay Sekulow and John Dowd,(who resigned as Trump’s lead counsel on March 22, 2018) was reported by CNN and New York Times. It is indicating that Trump’s attorneys believed that Trump could not possibly have committed obstruction in the Russia investigation because the Constitution empowers Trump to “terminate the inquiry, or even exercise his power to pardon if he so desired.” On Monday, June 4, 2018, President Donald Trump tweeted that he has the “absolute right to PARDON myself” and compared the special counsel’s investigation as “Witch Hunt“. Republican Senator Chuck Grassley, Chairman of the Judiciary Committee commented that “If I were the President of the United States and have a lawyer who told me that I can pardon myself, I think I’d hire a new lawyer.”
Throughout American history, no president has ever pardoned himself. Its legality is a matter of legal debate. A three page memo submitted in 1974, by Mary C. Lawton (Acting Assistant Attorney General) from the Department of Justice Office of Legal Counsel, just days before President Richard Nixon resigned, indicated that the President cannot pardon himself because “no one may be a judge in his own case.” If Trump faced indictment and pardoned himself, then the next step may be one of the two possibilities below:
- Congress may start the impeachment process (after more than half of the House Judiciary Committee approved that impeachment charge should be in place.) Video below describes the procedure for impeachment:
- Court challenges the validity of the pardon, with the President’s fate to be decided by judges
Perhaps President Trump needs to consider leaving things to his attorneys and possibly considering taking a page out of Nixon’s playbook by talking to Vice President Pence. It may be the best thing for the country.
